The 2004-2005 more usuage of EB visas for Indians is done because those were approved through AC21's unused visas i believe between 1999-2000 which are quota independent and not just from the annual quota of 140K. Hence in 2004-2005 there were more usuage. Starting from 2006 only thing left is the annual quota of 140K with per country quota of 7% at the max which has to be split among several EB categories in some proportions (roughly 1/3 among EB1, EB2, Eb3).The spillovers within 7% alone can be redistributed within a country's EB quota in the final quarter of the year. Hence the max India can get is 7% no matter how much gets spilled over from the rest of the world. THe only way to get the spillover back into the picture is another law enactment everytime it happens to get it back which is slow and painful process. Hence in nutshell to remove retrogression the easiest way is to remove country cap is or increase it . Else it is always going to stay even if annual quota is increased or through anyother measures. Hence I would recommend positively IV to focus on doing it and not mere increasing the quota.

PLEASE HELP ME OUT!!!!
i could not file for the H1B this year and now i am trying to get a job at a non-profit org.
-my OPT expires 1st of week of July, is there a deadline for me to apply for H1B through non-profit?
-how long will the premium processing take and where can find all the necessary information (requirements etc.) to apply for this?
-if my OPT expires and i transfer to F1 can i still apply for H1B through non-profit org while I am on student visa??

I mean i filed without both of those. Theyare required in the 140 phase , not in 485.
But keep them handy - in case they wants mail by next day air
if you are filing for your spouse and if you are sponsoring your spouse, you have to show evidence of income.. There is a form that you fill with it,.

Thank you for your input, do you know where I should call, if there is a number and so on? There is absolutely no information on any place on fixing 485 form.
I just called the 1-800 number on their website, but your lawyer may know someone in person at the USCIS.

LC Salary:- $85,000
LC Location:- New York
New Job Salary:- $74,000
New job Title and Job duties are same.
Is it advisable to invoke AC21 when new job salary is less than original LC salary but more than prevailing wage of new location.
As per Aytes memo there should not be substantial salary difference. Has anyone invoked AC21 when new job salary is less than LC salary.
I've consulted few immigration laywer and the opinion differs.

Another front to think about :
Recently I have heard that when the company publishes advertisement for the labor when filling for fresh PERM, every time there is a response coming back because of the higher rate of unemployment in the market. The issue is, if any response comes back then the company cannot proceed with the labor and new GC process gets hung.
So, to be on safer side just check on ur skill set before resigning the current job as it should not be readily available in the market.

Just an additional question, what happens if the parents are in the I-485 applied stage and the baby is born outside of US ?
I would call it expensive mistake.
The child has to apply for immigrant visa as follow-to-join, unless, of course, if child is still eligible for H4 visa. In that case, he/she can file for I-485 in the US if the PD is still current.

I did have a LUD on 09/05 and 09/08 and then RFE was issued. Responded to the RFE on 09/22 . LUD on 09/22, 09/23 ,09/29 and 09/30.

Me and my spouse both have RFE....so i dont know what to expect. And I have used AC21 and changed jobs....I am just hoping it is not related to this.

I would like to make most of the form thread details be accessible to members who had paid at least $100 or enrolled for recursive $20/month. We should make the thread heading very attractive and make it accessible to public. Core members should review all the thread headings, I think they are already doing it now. I can volunteer to this activity. I do have 8 years of experience in studying US immigration law, though I am not a lawyer, with my experience I can be of some guidance.

Provide advertisement (Ad), like we see top, right side and bottom page Ad in hotmail, yahoo etc. Apart from the flash, images Ads, we should also do Google text Ads. Flash Ad could be charged based on the space, number of page hits. Google pays 25 cents per click on the hyperlink for the text Ad. I had managed a project, which implemented the feature. I am sure we have lot of technical experts and get this implemented, very well.
Corporate Sponsorship
If a corporation sponsors money then most probably there will be some tax advantage. I do know IV�s tax code. Consulting companies could pay IV from our company account.
Physicians
We can identify all our physician members and provide help for members and their parents in need. In turn the members who had taken help could contribute to IV�s good cause, in terms of funds, taking part in activities, etc. Hi the concept is very simple, if you had gone to a doctor, you will end up spending 2 hr waiting to see the doctor and then pay 150 to talk to them for 15 min. We will help you and intern you help us, or may be help yourself if you are a person going through the GC process. I can take initiative for this task, my wife is a physician and I know 20 other doctors who are in the GC process.

I agree. UnitedNations has been tirelessly providing inputs to a lot of GC cases especially the 3 year degree issues on http://www.immigration.com. His vast knowledge in these areas can surely serve as a valuable knowledge base for potential and current GC applicants. I have been following his posts on http://www.immigratio.com for around 2 years now and his inputs has benefited me in take proactive measures for my employment based GC appliction. Hope we can continue giving his valuable advice on this forum too.
